These are programs not often used in local bankruptcy
practice. Chapter 11 is a reorganization proceeding somewhat akin to
Chapter 13. The main
differences are that whereas there are limitations on the amount of debt one
can have and still qualify for
Chapter 13, there are
no such limits in Chapter 11. Also, Chapter 11 does not have the ‘super
discharge’ of Chapter 13.
There are certain other provisions in Chapter 11 which may be an advantage
or a disadvantage, depending on your circumstances. Chapter 11 proceedings
are quite complex and time-consuming, and are therefore costly.
Chapter 12 is a program designed for the family farmer. Like Chapter 11
and 13, it is a
reorganization proceeding but it is specifically designed to rehabilitate an
ongoing family farming operation.
